Democratic Lawmakers Urge Trump Administration to Pardon Federal Cannabis Prisoners

A coalition of 28 Democratic lawmakers, joined by independent Senator Bernie Sanders (VT), has formally requested President Donald Trump and his pardon czar Alice Marie Johnson to issue pardons for individuals currently incarcerated in federal prisons for non-violent cannabis offenses. This move highlights a continued focus on the legal and social implications of past cannabis convictions, according to a Ganjapreneur report.

The lawmakers’ letter, dated May 22, 2026, underscores that the administration’s decision to move cannabis from Schedule I to Schedule III under the Controlled Substances Act, while a significant regulatory adjustment, does not provide relief for anyone currently serving time for a marijuana conviction. This distinction is crucial for understanding the scope of recent federal policy changes and their limited impact on existing sentences for federal cannabis prisoners.

Addressing Federal Cannabis Prisoner Incarcerations

The letter cites data from the U.S. Sentencing Commission, estimating approximately 3,000 individuals are federally incarcerated for cannabis trafficking offenses. Additionally, hundreds or thousands more are reportedly serving mandatory minimum sentences of five years or longer for related offenses. The lawmakers argue that these sentences represent an outdated approach to cannabis policy, especially given the widespread state-level legalization of cannabis in various forms.

Beyond the direct impact on individuals, the lawmakers also pointed to the operational benefits of such pardons. Releasing federal cannabis prisoners could help alleviate overcrowding within the Bureau of Prisons (BOP). The letter states, "While it won’t solve the structural issues that have led us here, we believe that commuting the sentences of people with marijuana offenses would both address the overly harsh sentences while simultaneously allowing BOP to focus resources where they are needed most."

The initiative was led by Representatives Steve Cohen (TN) and Steven Horsford (NV), alongside Senator Cory Booker (NJ). The letter garnered broad support from a diverse group of legislators, including Senators Elizabeth Warren (MA), Jeff Merkley (OR), Ron Wyden (OR), and Ed Markey (MA). Other notable signatories included Representatives Hank Johnson (GA), Troy Carter (LA), Shri Thanedar (MI), Rashida Tlaib (MI), Jonathan Jackson (IL), Bonnie Watson Coleman (NJ), Jared Huffman (CA), Valerie Foushee (NC), Frederica Wilson (FL), Jesus “Chuy” Garcia (IL), Pramila Jayapal (WA), Dan Goldman (NY), Dwight Evans (PA), Alexandria Ocassio-Cortez (NY), Dina Titus (NV), Ilhan Omar (MN), Eleanor Holmes Norton (DC), Nikema Williams (GA), Summer Lee (PA), Chris Deluzio (PA), and Val Hoyle (OR).

This collective action by lawmakers signals a continued push for comprehensive federal cannabis reform that extends beyond rescheduling to address the consequences of past enforcement. The focus remains on the legal and humanitarian aspects of current incarcerations, particularly as the federal stance on cannabis evolves.
