Louisiana Medical Cannabis Access Expanded in Hospitals

Louisiana lawmakers have passed legislation allowing patients with terminal and irreversible conditions to use medical cannabis in hospitals, sending the bill to Governor Jeff Landry for consideration. The House of Representatives approved the measure in a 54-44 vote, following its earlier passage in the Senate by a 33-2 margin, as reported by Marijuana Moment. The bill aims to expand Louisiana medical cannabis access for patients in palliative care settings, addressing a gap in current regulations. Senator Katrina Jackson-Andrews (D), the bill’s sponsor, stated that the legislation was brought forward at the request of constituents seeking to ensure therapeutic medical cannabis, already legal in the state, could be administered in hospitals for terminally ill patients.

Key Provisions of the Legislation

Under the proposed legislation, hospitals would be required to establish written guidelines enabling covered patients to consume medical cannabis on-site. Specific stipulations include:

  • Permitted Forms: Medical cannabis consumption would be restricted to forms other than smoking or vaping.
  • Exemptions: Emergency and outpatient departments would be exempt from this policy, an amendment adopted by a Senate committee.
  • Patient and Caregiver Responsibility: Patients and their primary caregivers are responsible for acquiring and administering the medical cannabis.
  • Secure Storage: Medical cannabis must be stored securely at all times in a locked container provided by the patient.
  • Staff Limitations: Health care professionals and staff are prohibited from administering, storing, retrieving, or assisting the patient with the medical cannabis.

An amendment, developed in collaboration with the Louisiana Hospital Association, also includes a provision allowing hospitals to opt out of the policy if federal officials initiate action against any healthcare facility in the state due to medical cannabis use. This expands the opt-out clause from only facilities specifically targeted to any facility in the state facing federal repercussions.

Broader Legislative Context in Louisiana

Beyond the medical cannabis measure, the Louisiana legislature has been active on other drug policy fronts. Lawmakers have advanced a bill to the governor that would impose penalties, including potential jail time, for individuals found smoking or vaping cannabis within 2,000 feet of school property, including college campuses. This contrasts with other legislative proposals that have emerged during the session.

Separately, a proposal has been introduced to create a psychedelic-assisted therapy pilot program, which would utilize opioid settlement funds to support clinical trials for alternative treatments such as psilocybin and ibogaine. Additionally, legislative discussions have included proposals for a state task force to study the potential legalization of recreational marijuana and a bill to establish an adult-use marijuana legalization pilot program. These various legislative initiatives reflect a range of approaches to drug policy reform currently under consideration in Louisiana.
