TSA Confirms No Changes to Medical Cannabis Policy for Air Travel Amid Clarification Efforts

The Transportation Security Administration (TSA) has confirmed that its medical cannabis policy regarding air travel remains unchanged. This clarification was provided to Marijuana Moment following recent inquiries about potential adjustments to guidelines for passengers carrying medical cannabis products.

According to the TSA, any recent updates to its website were made for clarity and conciseness, not to introduce new regulations. The agency’s stance continues to align with federal law, under which cannabis remains illegal, despite varying state-level legalisation.

TSA Clarifies Medical Cannabis Policy

The Transportation Security Administration reiterated that its operational procedures concerning medical cannabis have not been altered.

This means that even in states where medical cannabis is legal, transporting it across state lines or through federal checkpoints like airports can still lead to legal consequences under federal jurisdiction. The agency’s communication emphasised that “TSA’s policy remains the same. No changes have been made.”

Legislative and Research Developments Impacting Medical Cannabis

Louisiana Bill for Hospital Use

In a related development, Louisiana lawmakers have advanced legislation to Governor Jeff Landry (R) that would permit patients with terminal and irreversible conditions to use medical cannabis within hospitals. This bill includes specific limitations on its use in healthcare settings, aiming to balance patient access with institutional regulations.

Veterans Affairs Legislation

At the federal level, legislative efforts continue to address medical cannabis access for veterans. Two House bills recently gained additional cosponsors:

  • A bill designed to allow Department of Veterans Affairs (VA) doctors to issue medical cannabis recommendations.
  • A separate bill aimed at protecting veterans from losing their benefits due to medical cannabis use.

These legislative initiatives reflect ongoing efforts to align federal policy with the medical needs of veterans.

Cannabigerol (CBG) Research

Scientific research continues to explore the properties of cannabinoids. A new study has identified that cannabigerol (CBG), a cannabis component, exhibits anti-inflammatory capacity. The research suggests CBG has potential in regulating neutrophil-mediated immunity, specifically noting its regulatory effect by limiting inflammatory immune cell recruitment to inflamed joints in rheumatoid arthritis.

Federal Enforcement Context

Despite state-level reforms and ongoing legislative debates, federal agencies maintain their enforcement posture regarding cannabis. Customs and Border Protection (CBP) recently issued a Memorial Day travel advisory, reminding the public that “while legal in some municipalities, marijuana remains illegal under U.S. federal law.” This advisory underscores the continued federal prohibition that impacts interstate travel and federal property, including airports and border crossings.

These developments highlight the complex and often conflicting landscape of medical cannabis regulation in the United States, where federal law continues to diverge from state-level policies and evolving scientific understanding.
