Colombian Lawmakers Advance Cannabis Legalization Bill Through House Committee

Lawmakers in Colombia have advanced a bill aimed at comprehensive Colombian cannabis legalization through its initial legislative hurdle. The First Committee of the House of Representatives approved the measure, introduced by Representative Alejandro Ocampo, on Tuesday. This decision moves the legislation to the full House for further consideration before potentially proceeding to the Senate for two additional votes, as reported by Marijuana Moment.

Representative Ocampo stated via social media that the bill seeks to regulate the entire cannabis supply chain, from cultivation to the finished product. He emphasized the intent to control sales, ensuring products are sold in regulated environments requiring identification, permits, and licenses. This legislative effort builds on previous attempts to reform cannabis policy in Colombia, including a 2023 constitutional amendment proposal that did not pass its final stage, and another bill that stalled last year.

Legislative Framework and Presidential Support

The current legislative proposal outlines a framework for adult cannabis use and aims to integrate specific communities into the legal market. President Gustavo Petro has publicly supported cannabis legalization, advocating for reform to mitigate the influence of illicit drug trafficking and associated violence. In late 2023, President Petro criticized lawmakers who shelved a previous legalization bill, asserting that such actions perpetuated the illegal trade.

Key provisions of the bill, as reported by Infobae, include:

  • Adults over 18 would be permitted to purchase up to 20 grams of cannabis flower or 5 grams of concentrates daily.
  • A 20 percent tax would be applied to sales.
  • Personal cultivation of up to 20 plants per person would be allowed.
  • Individuals with past cannabis-related convictions could seek expungement of records and release from incarceration.
  • Non-profit cannabis clubs could cultivate up to 200 plants to supply their members.

The legislation also mandates that at least 50 percent of legally distributed cannabis must originate from crops grown by ethnic and peasant associations, with 70 percent of cultivation licenses reserved for these groups. Advertising for cannabis products would be restricted to prevent underage exposure, and the government would conduct public awareness campaigns regarding potential harms of use.

Economic and Social Impact of Colombian Cannabis Legalization

The push for Colombian cannabis legalization is framed by proponents as a strategy to address historical social and economic challenges. Representative Ocampo highlighted the bill’s potential to benefit vulnerable populations, including homeless individuals, farmers, and indigenous and Afro-Colombian communities who have a long history with the plant.

The country’s justice minister noted in a 2022 Senate panel hearing that Colombia has endured significant consequences from what he termed a “failed war” of prohibition.
